Raj Kundra Moves Bombay High Court; Calls His Arrest Illegal-Report
Raj Kundra who was arrested on Monday will be in custody till July 27. The businessman had appeared at the court where he was clicked greeting paparazzi with folded hands.
The Mumbai police got the extension of his custody on the basis of him not being cooperative to the questions being asked.
As per reports Raj challenged his arrest as he was taken in custody under the garb of his statement, “Notice in the matter where FIR is registered on 05.02.2021, the Charge sheet is filed on 03.04.2021 and they could have easily served notice and could have allowed the Petitioner to appear and give his statement and if the Petitioner failed to do so the consequences would had followed. However, if the Petitioner did appear then under Section 41A (3), he should not be arrested at all, is the mandate of law,” the plea avers.
While Kundra’s lawyer Abad Ponda too spoke to ET where he said that not a single video can be called porn and his arrest is illegal, “Raj Kundra’s arrest is illegal. There is not a single video which can be called pornographic. A 4000 page charge sheet has been filed but the police not even able to point out any sexually explicit act in the video which demonstrated illegality under section 67a. Rest of the section applied are bailable.”
Mumbai Police has just a while ago reached Raj Kundra’s Juhu residence with the search warrant.
